Below is an updated ruling on a recent case as reported in Legal & Medical on 14th December. Unfortunatley this type of problem is not as rare as you may think:

£1million compensation has been awarded to a woman - 17 years after being injured in a road accident.

Nicki Webber, now 26, was nine-years-old when she was knocked down by a car while chestnut picking by the side of the A631.

She suffered head injuries and was in a waking coma for eight weeks, leaving her needing care for the rest of her life.

Shortly after the accident, her family followed the advice of a firm of solicitors and two barristers, the claim was settled in 1996 for £150,000.

However, in settling for £150,000, her current team of lawyers argued the leading barrister then advising Nicki had "made an error" which had passed unnoticed by the rest of her then legal team.

The end result was that her case was settled at a fraction of its potential value.

As a result, the family sued the solicitors firm and barristers who advised her before the 1996 settlement and her current lawyers told the judge that - without admitting liability - they had agreed to a million-pound compromise of her case.

Nicki, a Harworth and Bircotes parish councillor, said the money would not change her in any way.

"No amount of money can make up for what I have been through over the last 17 years," she said.
