I broke my neck in 1984 in a road traffic accident, which left me with an injury at C4/5.

I received compensation in 1988/9.

Slowly over the years, my Health Care/”Social Care” has gone from being totally supplied and funded by the NHS, to provision and partial funding by social services, to private provision funded by me.

Even though I have been to welfare rights officer has been many times over the years, I was never informed about Personal Injury Trust.  I found out about Personal Injury Trust, about three years ago.  When I enquired about it, I was informed it was too late to arrange one.

Now, because my monies are now not in a Personal Injury Trust, I am looking at an annual “Social Care” bill of £20000.

Clearly with the introduction of a personal injury trust, the government did not intend monies given for injury compensation to be taken away to fund care.  Clearly because of the situation at the time of my injury, I received no money to fund my care.

So my obvious question is, do I have any legal avenues I can go down to redress my situation?

Thank you in anticipation; tremulous Tetra
